He did enough on Australian debut to suggest he’s acclimatized well to his new conditions, and with James McDonald happy to stick aboard this lightly raced five-year-old, Changingoftheguard must be considered the one to beat. He showed plenty of promise early on, finishing fourth in the Group 1 Sistema Stakes (1200m) as a juvenile before returning the following season to win the Group 2 Avondale Guineas (2100m) and place in the Group 1 New Zealand 2000 Guineas (1600m), Karaka Million 3YO (1600m) and Group 3 Manawatu Classic (2100m). He continued on his upward trajectory as a four-year-old last term, breaking through for his maiden elite-level victory in the Group 1 TAB Classic (1600m) at Trentham in December and repeated the same result in the inaugural $1 million Aotearoa Classic (1600m) at Ellerslie a month later, before placing in the Group 1 Otaki-Maori WFA Classic (1600m). TAB New Zealand is set to acquire the Raceform brand and magazine publication (Raceform) from Raceform Publications Limited. The agreement will see TAB NZ take ownership of Raceform, which distributes a weekly magazine providing previews, news, opinions, fields and tips on New Zealand thoroughbred and New Zealand harness racing, as well as coverage of major Australian metropolitan thoroughbred meetings. The transaction is expected to complete at the end of the month. TAB NZ will be taking up a business with a strong retail presence and loyal set of subscribers. “This agreement secures another strategic media asset, which preserves magazine format racing coverage in New Zealand and provides a clear pathway to digitisation,” TAB NZ CEO Nick Roberts said. “Raceform is synonymous with racing lovers across New Zealand, and Dennis Ryan and Don Hancock can be proud of the lasting legacy they have built for the New Zealand racing industry. This weekly publication gives punters exceptional coverage and insights on the racing events of the week. So they've bought essentially the same publication at least twice? Leading NT trainer Phil Cole has two genuine contenders in the feature races at Birdsville in outback Queensland on Friday and Saturday. Darwin trainer Phil Cole is looking for further success at the iconic Birdsville Races on Friday and Saturday. Cole boasts a decent strike rate in the south-west corner of Queensland after four previous visits with eight wins and 13 minor placings. Two years ago, Cole won the Birdsville Cup (1600m) with Saccharo before taking out the Open Handicap (1300m) with Kronos. The Birdsville Race Club switched the Friday meeting in 2022 to Sunday because of torrential rain. In 2023, Cole won the Open Handicap with Vunivalu with talented Top End apprentice Emma Lines in the saddle. Cole and Lines went on to become Birdsville’s leading trainer and jockey last year. Leaving Darwin with 12 horses, Cole will saddle up 15 runners on Friday and Saturday with Star Magnum in the Open Handicap and Saccharo, sidelined last year with injury, returning for the $50,000 Birdsville Cup. Having raced at Mt Isa a fortnight ago, Cole was at Betoota – 167km east of Birdsville – last Saturday, where he had a win with Awen before Turnstar saluted, with stablemates Lord Fenrir and Preconi filling the minor placings. “Betoota has never been a great hunting ground for me,” Cole said. “A couple of my better horses were disappointing, but they did have a great deal of weight. “They’re better weighted this week at Birdsville – more importantly they’re well.” Star Magnum, who had two wins during the Darwin Cup Carnival, and Saccharo, who boasts good form in Darwin, Alice Springs and Queensland, are genuine contenders. “Star Magnum, third at Betoota, is going to be better suited going back to racing in an anti-clockwise direction and Birdsville will be a better surface,” Cole said. “The horse is a class animal and although it’s a small field of four, he’ll carry 62.5kg after lumping 63.5kg at Betoota. “Saccharo, fourth in the Betoota Cup, has also disappointed running clockwise and 60kg in the Birdsville Cup is more manageable than the 62.5kg last week. “He holds the track record (1.34.48) here from two years back. “I’ve also got Awesome Lad in the Cup – he had a bleeding attack a while back and we rushed him back and then found out there were no races for him in Darwin. “He’s never raced in Darwin, so we brought him out here – he ran second at Mt Isa and knocked up a little bit. “He’s had a couple of nice gallops here at Birdsville, he’ll be fit and ready on Saturday.” Alice Springs apprentice Dakota Gillett has accompanied Cole this year, and after having a win at Mt Isa for local trainer Jay Morris on August 24, the 18-year-old saluted aboard Awen at Betoota. She will partner Star Magnum on Friday and Saccharo on Saturday. Awesome Lad (59kg) will have the services of Brisbane jockey Matt Gray in the Cup. Cole, who had a few transport issues en route to Birdsville, heads back to Darwin after next Saturday’s meeting at Bedourie – 187km up the road from Birdsville. The stewards at Charles Town Races on Wednesday issued a ruling that will not impose penalties against the licensure of trainer Justin Nixon after deeming that a “trace level” of a cocaine metabolite detected in a winning first-time starter he trained in March was the result of “inadvertent exposure” to that drug. West Virginia, along with Louisiana, are the only two states in America where Thoroughbred medication testing and enforcement are not subject to oversight by the Horseracing and Safety Integrity Act (HISA) and the Horseracing Integrity and Welfare Unit (HIWU). That's because of a preliminary injunction that is in effect while a lawsuit against HISA plays out in federal court. Under HISA and HIWU rules, benzoylecgonine, the main metabolite of the human street drug cocaine, is a “banned” substance that is never to be present in any covered horse at any time. Under West Virginia's rules, benzoylecgonine is a Class 1 drug, carrying a Category A penalty, the most severe classification. Yet despite the differences in jurisdiction, the Wednesday ruling by the Charles Town stewards is similar to how HIWU handled two cocaine metabolite positives in 2023. All three cocaine positives–the two under HIWU's jurisdiction last year and Nixon's positive in West Virginia–involved detections via blood samples, although the Charles Town stewards' ruling noted that urine testing was also utilized in Nixon's case. Back on Nov. 7, 2023, HIWU issued a press release that stated, “Recently, Covered Horses trained by Keri Brion and R. McLane Hendriks tested positive for [the cocaine metabolite] in blood. While controls in urine for [benzoylecgonine] have long been established, no corresponding testing specifications existed for blood. “These circumstances prompted HIWU to lift each trainer's Provisional Suspension and review scientific literature to determine appropriate testing specifications for blood such that it would correspond to existing controls in urine…. As a result of this investigation, HIWU concluded that the levels of [cocaine metabolite] detected in the blood samples for Hendriks' and Brion's horses will not be pursued as Adverse Analytical Findings,” the release stated. The Charles Town stewards' ruling from Sept. 4, 2024, explained the initial positive and subsequent split-sample positive detected after Tempest (Twirling Candy)'s win at 9-10 odds in his Mar. 23, 2024, maiden special weight debut: “Benzoylecgonine, confirmed to be present in Tempest's body while it was participating in a race, is a drug or medication for which no acceptable threshold concentration has been established by the West Virginia Racing Commission. Additionally, as the trainer of Tempest, Justin J. Nixon is the absolute insurer of and responsible for the condition of the horse… “[However], there are mitigating factors which cause the Stewards to impose no penalty against Mr. Nixon's permit in this matter. Those factors are as follows: Mr. Nixon's past record as a permit holder is good in that he has never had a medication violation in any jurisdiction since his first license in 1994. The amount of benzoylecgonine found in the horse is a trace level which lends credibility to the probability that the horse was inadvertently exposed to the drug in some manner. “Based upon an evaluation of the evidence, the Stewards conclude that the positive is attributable to inadvertent exposure. There is no reason to believe that Mr. Nixon knew of or caused the drug to be administered to the horse. “Pursuant to [a state rule], the Stewards are to determine medication violations on a case by case basis and may determine to impose no penalty against a trainer's permit, if warranted. Weighing and balancing these factors, the Board of Stewards find that while Mr. Nixon is held responsible for the positive in this case, the Stewards shall impose no penalty against Mr. Nixon's permit. “Therefore, the standard penalty for a first offense Class A medication violation (one-year suspension/$10,000.00 fine) is not imposed in this matter. In addition, the Stewards do not impose the 6 Multiple Medication Violation points that would typically be imposed,” the ruling stated. Tempest was, however, disqualified and the purse winnings were forfeited. On May 4, Tempest started at Laurel Park in a NW2L claimer (at the time, the colt was still considered a winner). He finished last in a field of eight. Relegated back to the maiden ranks because of the pending ruling, Tempest started in-and won-his next start, a maiden-claiming race at Colonial Downs on Aug. 29.
