  1. A legal petition spearheaded by the current president of the Pennsylvania Thoroughbred Horsemen's Association (PTHA) has made sweeping allegations involving bad-faith cronyism, corruption investigation obstruction, and more than a million dollars of “illicit and disguised ghost consulting payments” and “lame duck” contract awards that were purportedly authorized by and at times reportedly made to the PTHA's past president and the organization's current executive director. The purpose of the Sept. 6 civil petition filed in the Court of Common Pleas of Bucks County, Pennsylvania, by PTHA president Bob Hutt and PTHA board of directors member John Julia is to persuade a judge to use a state business corporations law to remove seven of the 11 current directors from the board because they have allegedly been complicit in the purported wrongdoing. The petition alleged that those board members have failed to carry out duties they were elected to perform on behalf of the 2,500 owners, breeders and trainers that the PTHA represents at Parx. Ray Paulick of the Paulick Report first broke the story. “Regrettably, for many years, PTHA was mismanaged by self-interested Directors with conflicting goals who conducted themselves without regard for their fiduciary obligations to PTHA and to the member Horsemen that it dutybound to represent,” the petition stated. “Their brazen and unlawful conduct harmed PTHA's mission, both financially and with respect to its power to advance measures and reforms benefitting the member Horsemen.” In November 2022, Hutt and Julia were among those newly elected to serve on the PTHA board. Hutt then ran for PTHA president under a reform platform, and he beat the long-entrenched Salvatore DeBunda, who had served four consecutive three-year terms as president and a total of nine terms on the board of directors. DeBunda, an attorney, is listed as the general counsel for the PTHA, and he serves separately as a member of the state body that regulates racing, the Pennsylvania Horse Racing Commission. The petition stated that as Hutt and other newly elected board members “have attempted to investigate and reform past misconduct, and have begun to discover past acts and omissions by former Directors, Legacy Directors and managerial employees, including criminal conduct, self-dealing, conflicts of interest and violations of the Bylaws, [the directors perceived as being loyal to DeBunda] have attempted to frustrate their efforts.” The petition stated that these so-called legacy directors “have created a voting block that, notwithstanding the fiduciary obligations each Director owes to PTHA, routinely vote to ignore, condone, and conceal past misconduct, perpetuate ongoing misconduct, and prevent PTHA, under the leadership of [Hutt], from taking timely and effective action to enforce its rights and recoup its losses. “Because Respondents exercise majority control over the Board, and have continuously utilized their majority control corruptly and in breach of their obligations to PTHA, their removal from the Board is essential to PTHA's ability to carry out its mission,” the petition stated. Hutt told TDN in a Tuesday phone interview that in the four days since his legal filing was first made public, he has received plenty of feedback. “The overwhelming majority has been very supportive and thanking [us] for having the guts to come forward and speak the truth about what has been known for decades,” Hutt said. Asked if he has also received threats of retaliation because of his whistleblowing, Hutt answered in one word. “Yes,” Hutt said, choosing not to elaborate. The directors that Hutt and Julia want removed are Jeffrey Matty, Jr. (who also is under contract to work as the PTHA's executive director), Kathleen DeMasi (the PTHA's vice-president), Charles Asensio, Jack Armstrong, Scott Lake, Robert Reid, Jr., and John Servis. The lawsuit stated that Edward Coletti, Jr. and John Fanelli, who both currently serve on the PTHA board, “have indicated their support for the initiatives sought by Petitioners and no relief is sought against them.” The accusations in the petition that refer to alleged money-related malfeasance nearly all tie in to DeBunda and Matty. TDN left several email and voicemail messages for both of them on Tuesday seeking their side of the story, but none of the requests for comment yielded replies prior to deadline for this article. It is important to note that the allegations made by Hutt and Julia do not constitute a criminal complaint, nor are the petitioners attempting to use the court filing to recover any purportedly misspent money. But the dollar sums in the petition are staggering, and it is possible that as the civil case proceeds it could generate interest from law enforcement that might result in separate criminal charges. The petition alleged that Dun Roamin Farms, the racing stable owned by DeBunda, was paid in excess of $380,000 by the PTHA between 2017 and 2022 for “ghost consulting” that involved no apparent services and no deliverables. “Moreover, the Bylaws precluded DeBunda from receiving compensation, directly or indirectly, for his efforts as President of PTHA,” the petition stated. “The final payment to Dun Roamin Farms occurred in December 2022, the final full month during which DeBunda served as President of PTHA. “Matty and the Legacy Directors were aware of these illicit and disguised ghost consulting payments to DeBunda, but attempted to conceal them from Petitioners. Moreover, Matty and the Legacy Directors, in violation of their fiduciary duty to PTHA, have prevented PTHA from taking timely action to recoup the improper payments,” the petition stated. Hutt and Julia also red-flagged $550,800 in PTHA payments between 2019 and 2023 to the law firm Archer & Greiner, where DeBunda is listed as being “of counsel.” “Notwithstanding his conflict of interest, and in violation of the express prohibitions set forth in the Bylaws, as President of PTHA, DeBunda funneled legal work to A&G,” the petition stated. “Matty and the Legacy Directors were aware of and acquiesced to the hiring of DeBunda's law firm and the payment of substantial compensation to A&G,” the petition stated. “In violation of their fiduciary duties to PTHA, Matty and the Legacy Directors have failed to take timely action to investigate the possible overpayment of fees and/or to recoup PTHA possible overpayments.” In a different section, the petition alleged that “commencing in or around 2015, PTHA began making payments to disgraced former politician Vincent Furno for alleged consulting.” The petition stated that, “In 2009, Furno had been convicted by a federal jury on 137 counts of corruption, conspiracy, fraud and other crimes,” and that “in excess of $215,000” was paid to Furno for his alleged consulting. “No apparent services were provided by Furno in exchange for the payments and Petitioners' investigation has revealed the existence of no deliverables,” the petition stated. “The final payment to Furno occurred in December 2022, the final full month during which DeBunda served as President of PTHA.” When the PTHA stopped paying Furno under Hutt's tenure, the petition stated, Furno, on Oct. 5, 2023, “threatened suit against PTHA for an alleged outstanding balance due of $52,500 for unpaid and past due consulting services.” Later, “without the knowledge or approval of the full Board, and notwithstanding the admonition of Hutt that ghost consulting is illegal and will not be tolerated by PTHA, Respondent Matty purported to negotiate a settlement with Furno on behalf of PTHA,” the petition stated. “In violation of the express limitations set forth in the Bylaws, Respondent Matty entered into a $30,000 settlement with Furno, and apparently signed a settlement agreement with Furno on behalf of PTHA without the prior knowledge and/or approval of Hutt or the full Board,” the petition stated. Matty's own contract to work as the PTHA's executive director was also listed in the petition as evidence of alleged overcompensation in exchange for loyalty to DeBunda. “Respondent Matty was initially hired by DeBunda as Executive Director in late 2021,” the petition stated. “On Jan. 4, 2023, while serving as the lame duck President of PTHA, DeBunda awarded Matty a three-year written Employment Agreement, which included a substantial increase in compensation, well beyond that of similarly situated executives with Matty's experience, and an unreasonable severance provision. A copy of Matty's contract that was filed with the petition lists his annual salary as $225,000. “Matty's Employment Agreement violates Section 5.11.4 of the Bylaws in that it exceeds the term of one year beyond the term of then President DeBunda,” the petition stated. “Matty's Employment Agreement falsely recites that it was reviewed by the Board and approved unanimously. To the contrary, the Board was not made aware that Matty's Employment Agreement would violate the terms of [the bylaws]. “The transparent motive for awarding Matty a three-year Employment Agreement on the eve of Hutt's term as President was to procure Matty's future continued loyalty to DeBunda, and to the other Legacy Directors, for the duration of Hutt's term as President,” the petition stated. “Not surprisingly then, throughout Hutt's tenure as President of PTHA, Matty has frustrated Hutt's efforts to lead PTHA, has run interference and placed obstacles in Hutt's path to investigating past misconduct and implementing reforms, has disregarded his duty to take direction from Hutt and to support Hutt's leadership, and has violated numerous express provisions of the Bylaws along the way,” the petition stated. “Respondent Matty's misconduct has included refusing to provide Hutt with access to PTHA financial records, personnel records, bank statements and cancelled checks,” the petition stated. The petition also stated a number of other alleged instances of misconduct in which “the Board has continually failed to represent the interests of the members of PTHA in contractual undertakings and negotiations with Parx.” The petition further alleged that, “On multiple occasions, Petitioners notified Parx of potential issues of 'race fixing' and demanded that prompt investigation and remedial action be taken to ensure the fairness and integrity of live racing at Parx. “Petitioners have provided evidence to Parx to support their claims and suspicions [and on] May 25, 2024, provided data to the Pennsylvania Racing Commission to support their claims and suspicions as well,” the petition stated. “Petitioners presented the same data and evidence to the Board and requested that the Board authorize PTHA to support the Horsemen in connection with the investigation of the claims and suspicions,” the petition stated. “Respondents, however, again chose not to represent the interests of the Horsemen members of PTHA, and instead voted not to provide financial or administrative assistance to the investigation of the claims.” The post PTHA Prez Alleges Years of ‘Brazen and Unlawful Conduct’ Involving ‘Illicit and Disguised’ Payments appeared first on TDN | Thoroughbred Daily News | Horse Racing News, Results and Video | Thoroughbred Breeding and Auctions. The World Tote Association (WoTA) members have elected its Board for the next two years, it was announced on Tuesday, with the Jockey Club of Turkey and Zeturf Group also being welcomed as full members. Fundi Sithebe, CEO of 4Racing in South Africa, and Keith Johnson, president of 1/ST Technology Group/AmTote have accepted nominations to co-chair WoTA. Riko Luiking, general manager of the German Tote, has likewise accepted the role of treasurer. Sithebe and Johnson take over from Alex Frost, CEO of the UK Tote Group, and Hans Lord Skarploth, CEO of ATG in Sweden. Sithebe and Johnson said in a joint statement, “We are delighted to be taking over as co-chairs of the World Tote Association. Over the last five years WoTA has made significant progress in developing the relationship between members and increasing understanding of the role pool betting plays in supporting horseracing around the globe. Warwick Racecourse, in partnership with the Thoroughbred Breeders' Association (TBA), announced on Tuesday that the second day of its Winter Festival on Thursday, November 21 will this year become Breeders' Day, with both the race programme and supporting activity centering around breeders and the breeding sector. Prior to racing, the TBA will host an educational forum designed for TBA members, and non-member breeding enthusiasts, covering a range of topics with expert panels and Q&A sessions. Full details of the panels and speakers will be revealed in the coming weeks, with an all-inclusive Breeders' Package available to purchase at a cost of £35 for TBA members and £55 for non-members. Following the morning forum, attendees can look forward to a seven-race card in the afternoon, where the feature is a class 2 veterans chase. The race programme has been put together to highlight breeder friendly races, including four mares' only contests, as well as a junior 'NH' hurdle. Each race will be sponsored by organisations from within the bloodstock industry and additional prizes awarded to the breeder of each winner. Eight races with purses and awards totaling more than $1.5 million will be offered as part of the Breeders' Cup undercard weekend according to an announcement Tuesday from Breeders' Cup Limited and Del Mar Thoroughbred Club. In addition to travel incentives, owners and trainers of contenders participating in the undercard races will receive race day seating, parking, and a range of other premium benefits. Five undercard races on the Nov. 1 program bolster Future Stars Friday, highlighted by the $200,000 Thoroughbred Aftercare Alliance Stakes for 2-year-olds at 1 mile on turf, and the $200,000 Senator Ken Maddy Stakes for fillies and mares, 2-year-olds and up at 5 furlongs on the turf; and two stakes races for California-breds on the main track with the $175,000 Golden State Juvenile Fillies, for 2-year-old fillies at 7 furlongs, and the $175,000 Golden State Juvenile, for 2-year-olds, also at 7 furlongs. There will be three undercard races on the Nov. 2 Championships Saturday program, anchored by the GIII Bayakoa Stakes for fillies and mares, 3-years-old and up, at 1 mile on the main track, and the GIII Goldikova Stakes presented by Yaamava Resort & Casino for fillies and mares, 3-years-old and up, at 1 mile on turf.   13. “Solid trade throughout the day,” was how Tattersalls chairman Edmond Mahony described the fifth edition of the September Sale of horses in training, which added 1,887,200gns to the company's turnover for the year. From a catalogue which had been reduced in size by a third from last year, 128 horses changed hands at Park Paddocks on Tuesday, headed by the 88-rated multiple winner Debora's Dream (Ire) (Sioux Nation), who was bought by Alan O'Keeffe, assistant trainer to Jennie Candlish, on behalf of Clare Dolan. The three-year-old colt, who was previously trained by Roger Varian and offered by Baroda Stud, was secured for 80,000gns. Baroda Stud ended the day as leading consignor with 14 sold, including the second-top lot, the 87-rated God Of Fire (Ire) (Muhaarar {GB}), who will be joining the jumps yard of Jonjo O'Neill. The four-year-old from the family of St Mark's Basilica (Fr) has won three times this year for Daniel and Claire Kubler. He was signed for at 70,000gns by Chris Dixon. “Jonjo rang and asked to to give him a shout when we were doing doing the catalogue if we saw anything that could do a job hurdling, so we put this horse forward,” said Dixon, who also bought three horses for his syndicate The Horse Watchers. “He has obviously progressed nicely since Dan and Claire have had him on the Flat, he has got a winning hurdler in his pedigree, the only one who has tried it. Muhaarar has had a few good jumpers over the last year or so and he might be one of those who make a bit of an impact as a jumps stallion with the right type of horse; I do think he is a good and underrated stallion.” A clearance rate of 77% was achieved from the 128 lots sold. The median improved by 25% to 10,000gns, while the average was down 14% at 14,744gns. In his closing statement, Mahony said, “This is the fifth edition of a sale that was introduced in 2020 as a response to the Covid-related delay to the Flat season and numerically the smallest, and whilst we may have been short of obvious stars, there has been solid trade throughout the day from both domestic buyers and those from further afield. Already named Acqua Rosa (Fr) and offered as lot 154, the April-born filly is out of the four-time winner Rose Tea (Ire) (Dylan Thomas {Ire}), a half-sister to the G2 Prix Greffulhe runner-up Handsome Devil (Ire) (Footstepsinthesand {GB}). The clearance rate picked up a little throughout the second session, settling overall for the two days at 62%. The 97 yearlings sold from 156 to go through the ring brought an aggregate of €919,000, which was markedly down on last year but from a smaller catalogue this time around and 50 fewer horses sold. The median of €8,000 and average of €10,090, were both slightly reduced from the 2023 figures. The award, which honors a new Thoroughbred owner who has been successful in the sport and has had a positive impact on the industry, has previously gone to names such as Jim and Dana Bernhard, Alexander Bregman, and MyRacehorse. To qualify, nominees must have made their first start as a Thoroughbred owner in the past four years (since 2021), had an ownership stake in a horse at the time it won a stakes race in the past 12 months, and had a verifiable owner license in 2024.   25. Both Melbourne and Sydney Spring Racing Carnivals have kicked into full swing, and last weekend the Group 1 Moir Stakes headlined the Moonee Valley program. From the two feature meetings in Victoria and New South Wales, we have found three runners that are worth putting in your blackbook, so you can follow them throughout their spring campaigns. Moonee Valley Track rating: Good 4 Rail position: True entire circuit Race 1: 3YO Handicap (1600m) | Time: 1:37.58 Horse to follow: Evaporate (1st) Evaporate brought up a winning hat-trick for the Ben, Will & JD Hayes stable after proving way too good for his rivals over 1600m, keeping his undefeated record at Moonee Valley intact. The son of Per Incanto jumped well from his outside barrier and pushed forward to settle outside the leader before kicking clear around the home turn. Michael Dee didn’t have to ride the winner out to the line, and he clocked off nicely to record a 2.75-length victory. When to bet: Post-race, Ben Hayes confirmed that Evaporate would return to the Valley for his third straight start and compete in the Group 2 Stutt Stakes, where he will be one of the key chances. Race 10: Benchmark 84 Handicap (1200m) | Time: 1:10.72 Horse to follow: Miss Aria (1st) Blake Shinn gave Miss Aria one of the rides of the day at Moonee Valley as he hugged the inside running rail, and the Danny O’Brien-trained mare sprinted past all of her rivals in the final 200m. This daughter of Zoustar clocked the fastest last 800m, 600m, 400m and 200m sections of the race and appears to have returned well from her winter campaign. In Queensland, the three-year-old filly finished second in the Group 3 Winx Guineas, and she is expected to compete in Group races during the spring. When to bet: Danny O’Brien mentioned the Group 2 Rose Of Kingston Stakes at Flemington as one of the targets for Miss Aria. She also holds a nomination for The Golden Eagle at Randwick on November 2, and with a massive $10 million prize pool up for grabs, expect her to be ready to peak in Australia’s richest four-year-old race. Randwick Track rating: Good 4 Rail position: +6m entire circuit Race 8: Group 2 Chelmsford Stakes (1600m) | Time: 1:33.76 Horse to follow: Adelaide River (4th) Adelaide River has only been to the races three times in Australia since being sent over from Europe, and his fourth-place finish in the Chelmsford Stakes was by far his best performance on Aussie soil. The Kris Lees-trained galloper failed to fire a shot in the Group 3 Lord Mayors Cup and Group 2 Q22 in Queensland before going out for a two-month freshen. The son of Australia settled midfield last weekend and ran through the line strongly over 1600m, which should bring him on for his second-up start over further. When to bet: Adelaide River holds nominations for all of the top Group 1 races in Melbourne and Sydney, so Kris Lees is likely to target the Group 3 Kingston Town Stakes at Randwick on September 21.
