Aquanita: Full Decision by Victoria Racing Appeals and Disciplinary Board

Now the Aquanita 8 have been found guilty and sentencing to follow, what odds Mr Birchley appeals? He is training only at the pleasure of the boss of QLD Racing, so, conundrum, what does transparency say, can Liam keep training, found guilty, or does he appeal and drag it out. It's not cheap, lawyers that is, they are facing disqualification and/or warning off.......Smerds is a shot duck, but this fella swears his innocence, so that being the case, Go Liam Go.....you honest bastard, show those legal eagles your smoking gun and blow them away.....#not drowning waving

Haven't followed this case but just read a brief article outlining the verdict and the findings against each of the eight.

The article talked about the top-ups (sodium bicarbonate and tripart paste), the thousands of text messages on Nelligan's phone, and Nelligna being caught inserting a syringe into Lovani's mouth, but the bit I'm unclear is why these top-ups hadn't been detected earlier?

Obviously it must be illegal to administer top-ups (hence the guilty verdicts) but are they not detectable in the samples they take from winners after the race?

Read Lee Freedman's tweet re this, he was vicious......The Herald Sun referred to Smerdon as legendary, pleeeease.....Tommy Smith was legendary. It now calls into question all those wins Smerdon has recorded against his name.....EPO found in his stables, the contaminated straw, and now this......hope to see Smerdon packing shelves at Woolies soon.....Birchley, well let's see as he has appealed so innocent until proven otherwise.

No Wally, from memory it was anti inflammatory ointment, I may stand corrected, but FBI were our neighbours for many years and they ran a brilliant org.......every arvo all the bro's were out walking horses with the strappers, one in each hand [horses]  walk for 40 min, and then a long pick.....horses came first for them, always.

Bi carb testing is done BEFORE racing.  It's all about timing, too early and the effect wears off, too late and you guessed it.

It says something about how inept the Racing Vic. policing was obviously.  They supposedly randomly test 30 odd per meeting but these dirty rotten cheating Smeerdons were keeping an eye out for Stipe's number plates and apparently had inside knowledge of who were going to be tested that day among other things.

If this happened here, under the Crimes Act, the perpetrator's could be charged with fraud, not just warned off as these grubs have been, along with meaningless fines which they simply won't pay.

Lee Freedman's suspension------ In this time Freedman was not immune from controversy. In March 1995 he was found guilty of substituting a horse in a barrier trial. To gain permission to run a horse, Central Express, in blinkers, it was necessary for it to run in a barrier trial, to demonstrate that the horse could properly run in them. Forced to run the trial the day before a race, Freedman substituted in another runner, Spanish Reign, for the trial. As such, Central Express ran in blinkers in the race, and duly won. Although Freedman said the substitution was for a good reason, not wanting to 'flatten' his horse before the race, he was suspended for four months. In this period, his brother Richard took over as trainer.
