Surely it is illegal by the RIU ? Same as a workplace scenario. If they refuse them entrance to the workplace, in this case a racetrack, it is taking away their ability to provide for their families. If found not guilty, RIU would need to cough up plenty. Had situations where i have worked previously, you knew people were flogging stuff, but no 100% evidence, had to pay a couple of workers 6 months suspended leave, then judge made company re employ one again? Was interesting times But in this case the RIU had the opportunity to present evidence to the JCA to continue the suspensions. Which they did. My understanding is that the evidence presented did not meet the threshold for the JCA to continue the suspensions. Considering that the threshold in the JCA is considerably lower than the High Court one must wonder about the strength of the evidence.
