its safe to say the person that was observed shelling out white envelopes to industry participants at the races was not acting on behalf of the riu

Same as a workplace scenario. If they refuse them entrance to the workplace, in this case a racetrack, it is taking away their ability to provide for their families. If found not guilty, RIU would need to cough up plenty. 

Had situations where i have worked previously, you knew people were flogging stuff, but no 100% evidence, had to pay a couple of workers 6 months suspended leave, then judge made company re employ one again? Was interesting times

Well, your employer has to suspend you on full pay, or let you still work until court proceadures are completed. So RIU didnt want to suspend, also would be liable if some not charged. 

Newmarket your second post doesn't make sense - can you please elaborate?

But in this case the RIU had the opportunity to present evidence to the JCA to continue the suspensions.  Which they did.  My understanding is that the evidence presented did not meet the threshold for the JCA to continue the suspensions.

Considering that the threshold in the JCA is considerably  lower than the High Court one must wonder about the strength of the evidence.  

Now that it seems disclosure is occurring surely we can expect the RIU to go back to the JCA?
