INCA Case Finally Dropped Against X, Y and Z
LongOwner replied to Chief Stipe's topic in Trotting Chat
Is this the quality of NZ Police - another shameful act of altering evidence and they had known for years and done nothing about it. There is a member of the RIU staff who has a similar approach to policing - obtaining a confession from a mentally impaired person who didn’t commit the crime - who received a nice cheque for wrongly spending a long period in prison . “ It is incontestable that Mr Turner’s visual description of the man he saw on 13 October 1985 was intentionally altered by the prosecution.” He said both the jury and Hall were deceived. Chisnall said what befell Hall at trial and afterward, brought into question the integrity of the justice system, when the problems were known in 1988 but nothing had been done until 2022. Crown lawyer Madeleine Laracy said there was no substantive opposition to the arguments raised by Hall’s legal team. Laracy said Chisnall’s characterisation of the case as a "trial gone wrong" was lamentably correct. “The Crown acknowledges that significant parts of the criminal justice process have failed Mr Hall, and serious hara/harm has been caused. The first step in relation to each, and redressing the legal wrong, is the public acknowledgement by the Crown in this Court that Mr Hall should be acquitted.” Chief Justice Dame Helen Winkelmann acknowledged the serious harm done to Hall and his family. -

Why didn’t the RIU do the whole thing in the first place to save the taxpayer - $12 plus million ? -

Wrong - I understand 2 out of 220 charges left . Those 2 very weak and based on an interview of a very jealous trainer - and ate BS. -

This has taken 5-6 years investigation and near 4 years since arrests for zero . $12 plus million taxpayer cost . Then at the very first press conference - suspension orders breached by the Chch Press ( hopefully charges to follow) - the NZPolice told us all the evidence was overwhelming and the charges will be heard promptly and dealt with by the courts. The charges of firearms was a cigarette lighter , tried to charging one over a trial drive , they had no money trail after wire taping for 2 years , and all the charges were of no substance . RIU , acting as the NZPolice experts , were found out to be useless and on a personal jealous crusade undertaken by failed cops and ex poor junior drivers.. So from go to end nearly 6 years , I told near 220 charges laid , we have zero . Drain the RIU swamp . -

I strongly favoured the accused and was told I had a mental problem as expressed my view on this and the RIU experience - failed police and poor junior drivers - as I had a deep seated anti authority mind set. I can hold my head up high and will just say I told you so. Now clean out RIU - everyone - and start again. -
At last some traction against the kangaroo court which rules with no balance, justice or fairness . Maybe a High Court judge who is not tied to the “closed shop” will make a ruling which has some relationship to the crime. Then a hard wire big broom can go through the RIU - as we thought was promised but the same old has continued .

UPDATE: On STUFF so must be true! Nasty Rumour Doing the Rounds
LongOwner replied to Chief Stipe's topic in Trotting Chat
The righteous cop statement, taking the moral high ground, is way outside the RIU and NZPolice terms of reference . Maybe they should look at the Police Club/Bar, every law office , Govt Dept which I understand Treasury is famous for etc and stop this anti harness racing crusade . If there is something fine charge them but the speech from the Altar is an over reach and not necessary. RIU and police is not the moral compass for the sport. -
The concept is great as Japanese gallops don’t mix well . I don’t know why the links and race film is so bad but impossible to watch

Terrible - if you do not have professional gear why try to do it

Unfortunately no one is willing to address the “kangaroo court “ structure, disproportionate penalties to the crime - check criminal court penalties - and arrogance. The structure was to get rid of the vindictive staff , failed ex policemen and go through it with a new broom . Nothing has happened ! Everyone is scared to speak up as the “court” will see they pay dearly for it . It is so un- professional it is an embarrassment and the new CEO is silent , toothless and gutless .

I totally agree - how can anyone feel they are getting a fair hearing and decision when the whole process is administered by the same person and the first hearing is in front of a closed group then the appeal is in front of part of the original closed group . Perception is very important and on looking from the outside the present system has no independent appeal process. The combined set up is judge , jury and executioner all in/from the same bed. The High Court bench is different from the District Court bench and Appeal court is different again . I don’t think the judge who set a penalty or found someone guilty would sit on the appeal bench . I have no faith in the system or personnel. Also , the obsession with retired - well actually well past retired - judges with a particular opinion who appear to have a preconceived idea or other bench appointments who are past their prime is a worry . Furthermore It looks like the retired judiciary member on the bench drives the decision and others sit there as a token gesture. Again maybe perception but a bench where they are well past their prime does not give me confidence. They are affecting hard working individual lives who have very little knowledge in any other business. They did not commit murder , undertake an armed robbery , manufacture meths , leaders in a drug ring etc etc . The penalties are so far above the crime it makes a mockery of the justice system or fairness or balance in this world we live . Maybe a more balanced panel including some younger with less ingrained views and less conservative would help. Maybe a fresh review of this marriage of the old system to new needs a total review - a complete independent review with no input from any existing and past members and staff. My opinion and it needs a few appeals to the High Court or higher to get change if the present Board and executive are not interested.

Well the big players in harness racing - Breeders & Owners - are based in Auckland or thereabouts. Take the sport away from them they will move to Ellerslie and take all their friends and $$$$. The population and the money is in Auckland - cut them off kill the sport.
-
Harness Racing needs Auckland to perform so we need to prop them until things even up and they improve . No Auckland Harness the sport will die .

Can anyone explain this RIB decision - 23 Feb 2022 - Race 6
LongOwner replied to Chief Stipe's topic in Trotting Chat
A bit like Ashburton - Same charge re running inside pegs before passing lane - R3 Blair Orange gets a day which equal to say 7 drives x $180 = $1,260 R8 Thornley - gets fine $200 not days off. All the same - why does Blair get more than 5 times penalty. They are not consistent . -
Another leak - nothing offical on RIU site Inside leaker to the press needs to be identified. Come on RIU you cannot flush out your own internal mole.
-
They have a full time Breeders representation on the staff - surely there role is the welfare of the breeder therefore help promote the sales.

Three Waters legislation is the most divisive piece of law this govt has on the books - will creat a huge divide. I do not agree with the fear propaganda re Covid-19 but if you study the Three Waters proposal and you with really think Covid-19 is like the common cold. The worst piece of proposed law / drafted law you will read written by the Govt Maori caucus for their own benefit. It is apartheid .

Assistant Starter at Addington Charged by RIB for Betting
LongOwner replied to Chief Stipe's topic in Trotting Chat
And a Mr L ( assumed previous starter ) when in the role asked his assistants what they had their money on - so the RIU take this case all the way when ex one of their own encouraged betting. Surely a chat in the office about the rules, tell the clubs to be professional re contracts/employment law and advise all ground staff what rules they fall under should of been the action. Total overzealous action/charge -
Post Vietnam more me - I guess I know more than you.
